Release and Waiver of Liability 

  

I hereby completely and fully release, discharge, and agree not to sue Rivkah Singh, Rivkah Belly dance,  Marrakesh Moroccan Restaurant, its partners, nonprofit partners, artists, employees, agents, volunteers, or any of its affiliates,  representatives, or contractors for any and all claims, causes of action or liability for any loss, stolen or damaged property, or injury sustained by participating in Belly dance classes or events on or off the premises of Marrakesh Moroccan restaurant, or its guests, guests arising out of or in any way associated with my participation or attendance of any Belly Dance Class or Event now or in the future. I understand that Marrakesh Moroccan Restaurant is solely providing the space to allow dance classes to take place and is in no way responsible for said classes other than providing a place to practice. I understand that Marrakesh Moroccan Restaurant does not guarantee professional dance spots now or in the future and it is up to the discretion and choice of the owner to select individuals for employment. Additionally, future teaching positions are up to the sole discretion of Rivkah Belly dance and by attending belly dance classes, I am in no way guaranteed a teaching position.   

I understand that by registering for classes, I do so at my own free will and by purchasing any ticket(s) for any show or Event, myself, and or my guests may be exposed to physical or mental injury or harm that is normally associated with attendance of events at performance events, musical events, or social gatherings. 

 I understand that by Belly dance classes are a physical form of performance exercise and I am of sound mind to participate. I understand that by participating in physical exercise, I have the consent of my medical professional and release Rivkah Belly Dance, Rivkah Singh and Marrakesh Moroccan restaurant from any liability associated with medical issues incurred due to a result of any medical conditions. I understand that a certain level of bodily risk is associated with the art of belly dance with or without props and participate at my own risk and that both Rivkah Belly Dance, Rivkah Singh and the premises of Marrakesh Moroccan restaurant are not responsible for any and all injury  

I understand that in order to register and secure a student spot in the belly dance classes, a registration form must be completed and $30 registration fee must be paid online prior to the first day of class. I further understand that Rivkah Belly Dance, Rivkah Singh, and or Marrakesh Moroccan Restaurant does not provide refunds of registration fees or classes and if I (the student) pays the registration fee and is a no show, I will not be refunded any payment. I understand that by registering on this site, I am securing a student spot in a limited space.

 I agree that this Release and Waiver of Liability shall be interpreted and construed in accordance to the law of the State wherein the classes and or event is hosted and or conducted and that am in agreement that this release and this waiver of liability herein will be construed to the maximum allowed by such law. I understand and agree that this Release and Waiver of Liability shall be binding upon my all my heirs, assigns and any personal entity acting upon my behalf. 

I have read the aforementioned items of the Release and Waiver of Liability, agree to abide by them, understand them, and hereby acknowledge that I understand this Release and Waiver of Liability.  I further understand that Rivkah Belly dance, Rivkah Singh, or Marrakesh Moroccan Restaurant does not provide liability insurance for the protection of organizations, individuals, nonprofits, groups, spectators, businesses, guests, contractors, or others that may participate in the belly dance classes or Events. 

 I understand that in order to participate in an Event or class, I hereby release and fully discharge Rivkah Singh, Rivkah Belly dance, Marrakesh Moroccan restaurant, and its officers, board, contractors, volunteers, and employees, jointly and severally from any and all actions, causes of actions, claims and demands for, upon or by reason of any damage, loss or injury, which hereafter may be sustained by participating in the Belly Dance Classes or events.  

This Release and Waiver of Liability is applicable to, extends to, includes, and covers all unforeseen, unknown, unanticipated, unsuspected injuries, damages, loss and liability and the consequences thereof. This Release and Waiver of Liability is also applicable to, extends to, includes and covers, any property, physical, mental, and or medical damages now disclosed and known to exist.  The provisions of any state, federal, local or territorial law or state providing substance that releases shall not extend to claims, demands, injuries, or damages which are known or unsuspected to exist at this time, to the person executing such release, are hereby expressly waived. 

I hereby agree on behalf of my heirs, executors, administrators, and assigns, to indemnify Rivkah Singh, Rivkah Belly Dance, Marrakesh Moroccan Restaurant, and its officers, board, contractors, and employees, joint and severally from any and all actions, causes of actions, claims and demands for, upon or by reason of any damage, loss or injury, which hereafter may be sustained by participating in classes or events. 

 It is further understood and agreed that said participation in the Belly dance classes or events  is not to be construed as an admission of any liability whatsoever and acceptance of assumption of responsibility by Rivkah Singh, Rivkah Belly dance, Marrakesh Moroccan Restaurant,  its officers, board, contractors and employees, volunteers, owners, jointly and severally, for all damages and expenses for which Rivkah Singh, Rivkah Belly dance, Marrakesh Moroccan restaurant its officers, board, contractors, and employees, volunteers, owners, become liable as a result of any alleged act of the  participant.

Event Photo Release and Waiver of Liability 

I understand that by purchasing any ticket(s) or participating in belly dance classes ,myself, my guests, may be photographed or recorded during an event or class. 

I do hereby consent and agree that Rivkah Singh, Rivkah Belly dance, Marrakesh Moroccan restaurant, its employees, or agents have the right to take photographs, videotape, or digitally record me during an Event or class and to use these in all media, now or hereafter known, and exclusively for the purpose of marketing, promoting, socializing, soliciting, and outreaching for classes, and functions. I further consent that my name and identity may be revealed therein or by descriptive text or commentary. I do hereby release Rivkah Singh, Rivkah Belly dance, Marrakesh Moroccan Restaurant, its agents, and employees all rights to exhibit photos and videos in print and electronic form publicly or privately in order to market. I waive any rights, claims, or interest I may have to control the use of my identity or likeness in whatever media used.  

I understand that there will be no financial benefit for royalties for photographing or recording me, either for initial or subsequent publication, transmission or playback. I also understand that RIvkah Singh, Rivkah Belly dance, Marrakesh Moroccan Restaurant, is not responsible for any expense or liability incurred as a result of my participation in this photo opportunity and/or recording, including medical expenses due to any sickness or injury incurred as a result. 

  Furthermore, I understand and agree that Rivkah Singh, Rivkah Belly dance, Marrakesh Moroccan restaurant does not reimburse travel expenses or parking expenses, parking validation, or parking fines incurred from partaking in any class, workshop, or event whatsoever.  I understand that as student and or guest,  I am responsible for the care and management of my personal belongings, and merchandise at all times.  I also agree that Rivkah Singh, Rivkah Belly dance, Marrakesh Moroccan restaurant does not provide refunds for any class, event, or workshop in full or in part whatsoever.  

 I represent that I am at least 18 years of age, have read and understand the foregoing statement and am competent to execute this agreement.
